NextPhases ("we", "us", "our") is a software development company based in Lusaka, Zambia. This Privacy Policy explains how we collect, use, store, and protect your personal information when you use our website, services, or products. We are committed to handling your data responsibly and transparently.

Plain language summary: We collect only what we need, we never sell your data, we don't use invasive tracking, and you can ask us to delete your information at any time. Read on for the full details.

This policy applies to:

  • Individuals who contact us via our website or email
  • Clients engaged for software development services
  • Users of NextPhases products, including Nsolo (our downloadable desktop game and future web version) and ExamGuard (our exam management platform, when available)
  • Users of any future NextPhases platform features, including account systems or community tools

2. Information We Collect

2.1 Information you give us directly

  • Name, email address, and company name submitted via our contact form
  • Project details including scope, budget, and timeline
  • Any additional information you choose to share in messages or during project engagements

2.2 Information collected automatically

  • Your browser's light/dark mode preference, stored in local storage on your device. This never leaves your browser.

2.3 Information we do NOT collect

  • We do not use advertising cookies or cross-site trackers
  • We do not use browser fingerprinting or covert identification techniques
  • We do not collect payment card details directly (payments are handled via third-party invoicing tools)

3. How We Use Your Information

  • To respond to your enquiries and project requests
  • To deliver the services or products you have engaged us for
  • To send project-related updates (only to active clients)
  • To improve our website, products, and services
  • To comply with legal obligations where required

We will never send you unsolicited marketing emails. We will never share your information with third-party advertisers.

Each of these services operates under its own privacy policy. We select third-party services that meet reasonable data protection standards.

5. Data Sharing

We do not sell, rent, or trade your personal information. We may share data only in the following circumstances:

  • When required by law, court order, or legal process in Zambia or another applicable jurisdiction
  • With service providers who help us operate our website and services, strictly for that purpose and bound by confidentiality obligations
  • With your explicit consent

6. Data Storage and Security

Your data is handled using industry-standard security practices. All traffic to and from nextphases.dev is encrypted via SSL/TLS. Contact form data is transmitted over HTTPS through EmailJS's secure infrastructure.

We retain your information only as long as necessary to fulfil the purpose for which it was collected, or as required by applicable law. Client project data is retained for a minimum of two years after project completion for record-keeping purposes.

While we take reasonable precautions, no internet transmission is completely secure. We encourage you not to share sensitive information (such as passwords or financial details) via our contact form.

7. International Users

NextPhases is based in Lusaka, Zambia. If you access our website or services from outside Zambia, including from the European Union or United Kingdom, your data may be transferred to and processed in Zambia. By using our services, you acknowledge this transfer.

For users in the EU or UK, we process your data based on the following lawful bases under GDPR and UK GDPR: your consent (where given), the performance of a contract with you, and our legitimate interests in operating and improving our services.

8. Your Rights

Regardless of your location, you have the right to:

  • Request access to the personal data we hold about you
  • Request correction of inaccurate data
  • Request deletion of your data ("right to be forgotten")
  • Withdraw consent for data processing at any time
  • Request a portable copy of your data
  • Object to how we use your data

9. Children's Privacy

Our professional services (web development, consulting) are not directed to individuals under the age of 16. We do not knowingly collect personal information from anyone under 16. If you are a parent or guardian and believe your child has provided us with personal information, contact us at info@nextphases.dev and we will delete it promptly.

Nsolo is a culturally focused digital adaptation of a traditional Zambian board game, available as a downloadable desktop application (Windows). It has no age restriction. Nsolo does not collect, transmit, or store any personal information. It requires no account creation, has no internet connectivity, performs no telemetry or analytics, and involves no in-app purchases. All game data is stored locally on the user's own device and is never sent to NextPhases or any third party.

10. Cookies and Local Storage

  • Theme preference: Stored in your browser's local storage to remember your light/dark mode choice. This data stays on your device and is never transmitted to us.
  • No tracking cookies: We do not use advertising cookies, session tracking cookies, or any third-party analytics cookies.

11. Our Applications and Products

NextPhases builds digital products alongside our client services. This section describes the data practices of our current products. New products will be listed here as they are released.

Nsolo (Desktop Application)

The Nsolo application (Windows .exe / .jar) is a fully offline, standalone program. It does not connect to the internet during normal operation.

  • No data collection: Nsolo does not collect, log, or transmit any personal information, usage data, device identifiers, or analytics of any kind.
  • No network requests: The application makes no outbound network connections. It does not ping any server, send crash reports, or check for updates automatically.
  • Local storage only: Any data saved (such as game preferences) is stored exclusively on the user's device and is never transmitted to NextPhases or any third party.
  • No third-party SDKs: The application does not include advertising SDKs, analytics libraries, or tracking frameworks.
  • Open source: The Nsolo source code is publicly available for independent verification at github.com/NextPhasesDev.

If your security software flags the Nsolo installer, this is a false positive caused by the application being unsigned (code signing certificates are a paid service we have not yet acquired). The application is safe. You can verify the source code via the GitHub link above.

ExamGuard (Coming Soon)

ExamGuard is an exam management platform for schools and institutions. When available, it will be governed by its own institutional licence agreement and a dedicated data processing addendum. This section will be updated when ExamGuard enters public availability.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page and, where changes are significant, notify active clients directly. Continued use of our website after changes have been posted constitutes acknowledgement of the updated policy.
